It is firstly stated that the present conditions apply to all sales of sports equipment and their by-products by Pure Magic. These conditions are in place and exclude all other conditions, notably those currently governing shop sales.

When navigating the Pure Magic website or when ordering one of the products offered on the website, the customer agrees to be bound by the present terms and conditions which apply to all offers, orders and agreements between the customer and the company.

The current terms and conditions are accessible to everyone on the website of Pure Magic. The company reserves the right make changes to the present terms and conditions at any time, provided these changes also appear on the website.

Clause 1 - Product prices

1.1 The prices of our products are shown in Euro and are inclusive of VAT. The price does not include added costs such as those of shipping and returns (see the deliveries and returns sections). The mode of transportation as well as the cost of delivery will vary depending on the weight and dimensions of the product and also on the distance travelled to the final place of destination. The total cost of delivery of the customer's order will be calculated during the ordering process.

1.2 All orders, regardless of where they originate from, must be paid for in Euro.

1.3 Pure Magic reserves the right to amend its prices at any time, however products will be charged at the current price in place at the time of order, subject to availability.

1.4 All products remain the property of Pure Magic until payment has been received in full.

Clause 2 - Ordering

2.1 All orders are processed directly on the Pure Magic website.

2.2 Each order is a confirmation by the customer that he agrees to the price and description of products.

2.3 All orders are subject to approval by Pure Magic.

2.4 The terms of contract are written in English and are subject to acceptance of these current terms and conditions at the time of delivery at the latest. Pure Magic reserves the right to cancel or refuse an order placed by a customer who is in litigation regarding the payment of a previous order. In addition, the company reserves the right to refuse orders and consequently deliveries to certain countries outside of the European Union, without having to justify this decision.

Clause 3 - Validation

You will have to declare to have read and accepted the general terms and conditions governing the sales of products currently in place before completing your order. For you order to be validated we require your acceptance of these terms and conditions. All information received by Pure Magic will be proof of all transactions between Pure Magic and its customers.

Clause 4 - Availability

4.1 Our product and price offers are valid while they are still up on the website, subject to availability. In the event of a product being temporarily unavailable after completing your order we will inform you as soon as possible by mail or by telephone.

4.2 In the event of a product being unavailable for a longer period of time (one month or longer), your order will be automatically cancelled.

4.3 If you have paid by card, you will be refunded the amount into the bank account that it was debited from.

4.4 If you have paid by cheque and in the event of all or part of your order being unavailable for a longer period of time, a refund will be given in a manner to be determined by Pure Magic, either through a credit transfer to the customer's bank account or by cheque and no later than 30 days from the date that the customer's payment was received.

Clause 5 - Deliveries

5.1 The products are delivered to the delivery address as specified by you during the ordering process. Delivery times as stated on the website are the normal average and correspond to the time it takes to process and deliver an order. Pure Magic can not be held responsible for the consequences of delays caused during the transportation of goods.

5.2 In the case of payment being made by cheque, the order will be processed on receipt of the cheque. As a result the estimated time of delivery will be from the date of the cheque having been received and may therefore differ from the estimated time of delivery given on the date of completion of the order.

9.1 The refund of products as set out in clause 8 will be arranged within 15 days of Pure Magic having received the returned goods.

9.2 The refund will be given in a manner to be determined by Pure Magic, either through a credit transfer to the customer's bank account or by cheque made out to the name and address of the customer who placed the original order.

9.3 In case of purchase of Gift Vouchers, either online or from the shop, the validity of these vouchers is 1 year starting from the purchasing date. The Voucher is not refundable either exchangeable. In case of cancellation from our side and only our side(weather conditions) then Puremagic may extend the validity of Voucher. Vouchers are not replaceable if lost, stolen or destroyed and will be invalid.

Clause 12 - Liability

12.1 Products presented on the Pure Magic website are conform with Irish Laws. Pure Magic will not be liable in the event of products being used in countries where the laws are different to those in Ireland. We advise our customers to check with their local authorities concerning these laws.

12.2 Concerning certain products, Pure Magic can not be held responsible for any mistakes concerning the representation of the product on the website and the actual condition of those product when sold (applicable for example for second-hand gear).

12.3 Concerning links from the Pure Magic website to other websites, Pure Magic can not be held responsible for the content of these websites.
